By accessing or using AppSell ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AppSell provides an interactive sales platform that enables retail stores to create and display gamified promotional content on tablets at checkout. The Service includes:

  • Interactive game templates (wheel, scratch card, special prices)
  • Lead collection and management
  • Analytics and reporting
  • Free and Pro subscription tiers

3. Account Registration and Security

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription Plans

4.1 Free Plan

The Free Plan includes:

  • Limited features and usage
  • No payment required
  • May be modified or discontinued at any time

4.2 Pro Plan

The Pro Plan includes:

  • Full access to all features
  • One-time annual payment (valid for 12 months)
  • No automatic renewal - you choose when to renew
  • 30-day trial period to test all features

4.3 Payment Terms

  • Payments are processed through PayPal
  • 30-day trial period - test all PRO features risk-free
  • All fees are non-refundable after the trial period
  • Prices may change with 30 days notice
  • Plan expires after 12 months - manual renewal required

5. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to spam, harass, or abuse others
  • Collect user data without consent
  • Resell or redistribute the Service
  • Reverse engineer or decompile the Service

6. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service
  • Non-payment of fees
  • Any reason we deem necessary to protect the Service or other users

You may cancel your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You agree that:

  • We may collect and use data as described in our Privacy Policy
  • You are responsible for obtaining consent from end-users for data collection
  • You will comply with all applicable data protection laws
  • We may retain data as required by law after account termination

8. Intellectual Property

The Service and its content, features, and functionality are owned by AppSell and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you create using the Service. By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless AppSell from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you create or distribute using the Service

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Israel. Any disputes shall be resolved through binding arbitration in accordance with Israeli law, except where prohibited by law.
